Terms of Service

These Terms of Service constitute a legally binding agreement between you ("User", "Player", or "You") and independent developer Deyvid Jaguaribe de Lira ("Developer"), concerning the download, installation, and play of the electronic mobile game entitled Pogomon (ポゴモン).

By downloading, installing, updating, or playing Pogomon on your mobile device, you confirm that you have read, understood, and agreed to all provisions set forth herein as well as our Privacy Policy. If you do not agree to any of these terms, do not install, copy, or use the application.

Pogomon is a casual strategic card battle and anime-styled visual novel game developed for the Android and iOS mobile platforms.

The game is distributed under a One-Time Purchase (Premium) model through authorized app marketplaces (Google Play Store and Apple App Store):

• No In-App Purchases (No IAP): The game does not sell card packs, virtual gems, premium coins, battle passes, or hidden microtransactions. Your initial purchase grants full access to all gameplay content created for the game;
• No Advertisements: The application does not serve banners, interstitial pop-ups, or rewarded video advertisements;
• Merit-Based Progression: All 52 collectible cards, story chapters, and arcade opponents are unlocked exclusively through your deck-building skills and duel victories.

Subject to your compliance with these Terms and your legitimate purchase through an authorized store, the Developer grants you a limited, revocable, non-exclusive, non-transferable, and strictly personal license to download, install, and execute Pogomon on compatible mobile devices that you own or legally control.

You acknowledge that the Pogomon application, along with all copyrights, trademarks, trade secrets, and other intellectual property rights therein, are and shall remain the exclusive property of Deyvid Jaguaribe de Lira.

This protection includes, without limitation:

• The title, name, and trademark Pogomon (ポゴモン), logos, and brand identity;
• The fictional universe of Lumina Bay, anime characters, dialogues, narratives, and story mode scripts;
• The illustrations, card frames, rarities (Common, Rare, Epic, Legendary), and five-attribute battle mechanics (Power, Speed, Guard, Arcana, and Heart) for all 52 cards;
• The compiled software code, architecture and visual interfaces

No title or ownership of intellectual property is transferred to you through the purchase of the app or your acceptance of these Terms, other than the personal license granted in Section 3.

Pogomon is fundamentally engineered to let you enjoy the full game experience completely offline. You are never forced to maintain an active internet connection to play battles, manage your card collection, or advance through story chapters.

However, network connectivity (via Wi-Fi or cellular data) is utilized in the following specific circumstances:

• Initial download, installation, and version updates via the Google Play Store or Apple App Store;
• Standard licensing validations managed by the mobile operating system's native store frameworks;
• Background transmission of anonymous technical crash reports and diagnostic performance telemetry, as detailed in our Privacy Policy.

Pogomon saves all of your game progress (unlocked cards, custom decks, match records, and audio settings) exclusively in the internal local storage of your mobile device.

As a consequence of this privacy-conscious and offline-first architecture:

• The Developer does not maintain individual player progress backups on external cloud servers;
• Uninstalling the game, performing a factory reset, using aggressive third-party storage cleaners, or changing devices without an official system backup (Google Drive / iCloud Device Backup) may cause the irreversible loss of local progress;
• The User is solely responsible for maintaining appropriate backups recommended by their device manufacturer. The Developer is not liable for lost game progress resulting from user actions, app deletions, or physical device malfunctions.

We strongly advise against running Pogomon on devices that have been subjected to rooting (on Android) or jailbreaking (on iOS) — the removal of native software sandbox protections enforced by the operating system manufacturer.

Such modifications can expose your device to security vulnerabilities, corrupt local save files, break application sandboxing, or cause software crashes. The Developer does not guarantee application stability or provide technical support for devices with modified operating systems.

The Developer may periodically release software updates for Pogomon through the official application stores (Google Play and Apple App Store) to:

• Resolve stability bugs or technical issues diagnosed through crash reports;
• Fine-tune numerical card balance, attribute die mechanics, or AI behavior to ensure fair, engaging, and competitive gameplay;
• Maintain compatibility with newer versions of Android and iOS.

Users are encouraged to keep the application updated to the latest available store build to guarantee maximum stability and performance.

Pogomon is provided "as is" and "as available".

While the Developer applies rigorous software engineering and automated test suites to deliver high stability, the Developer does not warrant that:

• The application will operate uninterrupted or completely error-free across all existing hardware configurations;
• The game will satisfy subjective expectations regarding artistic style or difficulty curve.

These Terms remain effective as long as you own or use the application. The license granted in Section 3 will terminate immediately without notice if you fail to comply with any provision herein (particularly regarding intellectual property rights and reverse-engineering restrictions).

Upon termination, you must cease all use of Pogomon and remove the application from your devices.

These Terms of Service are governed by, construed, and enforced in accordance with the laws of the Federative Republic of Brazil (including Law No. 12.965/2014 — Brazilian Civil Rights Framework for the Internet, Law No. 9.609/1998 — Software Law, and consumer protection statutes), without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved in the competent judicial district of the Developer's domicile in Brazil, without prejudice to non-waivable statutory consumer forum rights afforded by your jurisdiction of residence.
